A. A Probate Real Estate Sale, is real property governed by the probate court. When a person passes away and there is no will or the will be contested the court has a process of administrating the estate of the decedent and specifically in regards to the real estate owned by the decedent. This process of selling and purchasing this type of real estate is very different that a typical transaction. Most of the time these sales require court approval and the terms are very different from a traditional real estate sale.
