5 Ways to Get a Probate Home in Show-Selling Shape

Probate property is sold "as is." That means no painting, no repairs or fixes or tweaks to charm the potential buyer (painting and fixing could mask a defect in the house). The usual suggestions a real estate agent might offer for getting a home in "show-sell" shape may not apply. However, there are always things that can be done to help get a home ready to be sold, even when it’s a court-supervised sale.

  1. Work on curb appeal. Make sure that the lawn is mowed and all trash and debris are removed from the property. Trim overgrown trees and plants and rake around them.
  2. Have all the windows in the house washed inside and out. Let the sun shine in! Also remove damaged window coverings and heavy drapery.
  3. Remove stained and worn carpets. If you decide to leave the existing carpets in the house, have them cleaned professionally to remove odors. (Remember, a buyer may be sensitive to odors you can’t even smell.)
  4. Have a cleaning crew scrub the house, including all the nooks and crannies such as cabinets, shelves, closets, built-in drawers and utility room.
  5. Remove all personal property from the home, especially family heirlooms, photos, old clothing, etc.

Pricing it right for 2011

At the risk of sounding like a broken record, it’s time to mention (again) the importance of right-pricing for sellers who are serious about selling their property.

Emerging from the long-haul misery of a depressed market, we’ve noticed that there’s a little “magical realism” circulating among some sellers. Now that things are improving, these sellers seem to think, prices should bounce right back to where they were in 2006.

We don’t think that this market, or today’s buyers, will welcome higher prices. In fact, price seems to be one of the major factors keeping buyers away from new listings. With plenty of foreclosures and short sales still on the market, buyers are looking for opportunity they can afford.

Buyers are doing their home-work. They’re spending time searching online, studying values and making lists of essential and optional features. They know what they can afford – and how they’ll pay – and they’re ready to act when all the pieces fall into place.

Sellers might take a page from the buyer’s book: think like a buyer. Search the market as if you’re buying, not selling. Visit open houses and look at properties for sale that are similar to yours. Note particularly how long a property has been on the market because that often says something significant about the price.

There’s a right price in every market. The right price for 2011 is slightly below market so it attracts sellers and agents in good number and may even land the home in multiple-offer territory.

The Sanborn Team has another overbidder in probate court!

Our listing at 3342 Maceo was confirmed in court this morning. We had an overbidder who bid $15,000 over the first overbid amount. The original buyer really wanted the house and bid up another $5,000! It ultimately went to that buyer, who was very happy. The Sanborn Team was even happier since we were able to get more money for the estate.

The Sanborn Team works very hard to get the most we can for the executors, administrators, conservators, and probate attorneys who represent the estates we sell. Housing Market Index Encouraging

While The Sanborn Team focuses on the resale of existing homes, especially real property sold through probate, trust and conservatorship, we keep a close eye on what's happening in the new-homes market as well. Trends in new construction tend to have a ripple effect on employment, local economies and, sooner or later, home sales.

The National Association of Home Builders (NAHB) released its Housing Market Index on March 15 with a note of cautious optimism. Builder confidence is up to its highest level since "May 2010, when the survey period corresponded with the final days of the federal home buyer tax credit program," NAHB says. The West showed the highest gains.

What this uptick in the HMI means is that builders believe home-buyers will begin making new-home purchases in the coming months.

While the NAHB is far from enthusiastic about the market's immediate prospects, this new report suggests to us that home sellers need to be even more on-target with their pricing as competition from new homes gains momentum.

Overbidders in Probate Court!

Several of our probate listings have gone to court in the past couple of weeks. And we've been amazed at the number of overbidders who have gotten the property over the accepted offer!

My Client Cannot Be in Probate Court to Bid on a Property. What should I do?

Just this past week this question came up twice. Two buyers were expected to over-bid on a property.

The first buyer contacted us prior to the sale date. We were able to provide the buyer with detailed instructions on what the attorney for the estate would require in order for someone to bid on the buyer's behalf. Every attorney has his or her own guidelines, but in general most agree that the Power of Attorney needs to be specific to the property that is being sold.

The second buyer sent his real estate agent to court and did not contact us prior to the hearing. The estate's attorney was able to speak to the agent prior to the hearing and establish the ground rules under which he could bid. In this case, the agent had a Power of Attorney specific to the property, but he wanted to enter the name of the buyer as an LLC. This was not acceptable to the attorney, who stated that the name of the buyer for the purposes of the sale had to be an individual, not an LLC.

The bottom line? If you are buying real property through probate or trust, or if you are a real estate agent representing such a buyer, be aware that the court has no flexibility when it comes to overbidding. A phone call in advance to the estate's attorney or the probate real estate agent could save the sale and get you the property you want.

Cash-only homes on the rise

I recently read an article in the business section of the LA Times about how all cash buyers are grabbing homes in record numbers.


Nearly 100% of the Probate and Trust properties we list require buyers to pay all cash. This is because they are being sold "as is" with no contingencies, i.e. financing, inspections, appraisals or any approvals. And in most cases the Seller will not do any repairs including termite and retrofit. Who can afford such a deal? Investors that's who! We have definitely seen more investors and investor groups making offers as well as coming to court to overbid.


As the article points it's incredibly difficult to qualify for jumbo loans from lenders who are still reeling from the mortgage fallout. On the up side, unemployment is at its lowest since April, 2009. Since jobs are so directly related to the real estate market, we are hopeful that things will level off.

Is paperwork different in a Probate Sale?

With a keen insight of the marketplace and familiarity of the Probate Code, The Sanborn Team handles the sale of real property through Probate & Trust accurately and promptly. As you may know, the sale of property through Probate & Trust is not the same as the sale of property outside of the court system. Probate and Trust sales require special disclosures, listing agreements and purchase contracts.*
Since the seller of a probate has usually never lived in the decedent's or conservatee's house, they are not required to fill out certain disclosures that express the condition of the property. These disclosures are:

  • Real Estate Transfer Disclosure Statement
  • Earthquake Hazards Report
  • Statewide Buyer and Seller Advisory
  • Local Area Disclosures
  • Seller Property Questionnaire
  • Agent Visual Inspection Disclosure

Also, the listing agreement and purchase contract are different as well. Probate & Conservatorship listings must be on the Probate Purchase Listing Agreement and all offers must be on Probate Purchase Agreement.

You may also know that when it comes to the sale of real property through probate and trust, not all agents are created equal! Lack of experience can only lead to the trustee/administrator to fail finding the best buyer and fail to provide the correct paperwork that protects the trustee/administrator. Although to many real estate agents the sale of probate seems similar enough to a traditional transaction, this sale takes a comprehensive understanding of the court requirements.

What is a Probate Sale?

"Probate" is the court-supervised administration of a decedent's estate. The probate proceeding involves "proving the will" (if there is a will), appointing the personal representative, determining the decedent's assets that are subject to probate. More specifically, any property that the decedent owned or had an interest in at the time of death is collected into the estate and distributed to those entitled to it after all debts and expenses have been paid. Thus, the process of administering a decedent's estate is referred to as "probate" and is generally supervised by the probate court.

How is the overbid amount established?

When a property is sold at a court hearing there is open competitive bidding. It is important to understand that in order for there to be a court hearing, an initial bid has to be accepted and the attorney for the estate must petition to have a hearing date.

The minimum first overbid price is set by a statute in the Probate Code. That amount is 5% of the accepted initial bid plus $500.

Further incremental bidding is established by the presiding judicial officer at the hearing.

Cashier's Check Requirements for Overbidding on a piece of Real Estate in a Probate sale

Although it may come as a surprise to most of you, there are some people out there that do not understand what a cashiers check is. Yes, some people refer to them as Bank Checks, however we came across an amusing situation worth sharing.


At a court hearing to confirm the sale of a piece of Real Estate, an interested buyer tugged the back of my sweater. She needed to speak to me so I followed her outside. I proceeded to ask her to show me the check that was required for her to make a bid on the piece of real estate that was being sold. She handed me a bank statement and a personal check. I explained to her that the check had to be a cashiers check in order for her to be able to bid on the real estate. Afther a series of exchanges, she explained to me that this check was a cashiers check. The check was made payable to cash - thus a cashiers check!


The overbidding party must appear at the hearing with thier agent and a cashier's check in an amount totaling at least 10% of the minimum overbid price in order to successfully overbid.

Words of Wisdom from a 90 year old!

I was checking out other real estate blogs, and came across the following GOOD ADVICE written by a 90 year old. With the holidays upon us, it felt timely. Live life to it's fullest!

How NOT to over bid at a Probate Real Estate Sale

Over Bidders at Probate Real Estate Sale

Does the buyer need to appear in court to purchase a piece of real estate?

One would think that the answer to that question would be obvious, however this week in court we had two real estate agents come to bid on behalf of their buyers. Both of the buyers were not with their respective agents. Both of the real estate agents were under the impression that it would not be a problem to bid on behalf of their respective clients.

If either of the agents had called The Sanborn Team and told us that they were not expecting their clients to accompany them to court we would have been able to provide them information on how they would be able to represent their absent clients. Alas, no one called in advance.

The agents did not understand that without proper authority there would be no way to bind their clients. That being said, if the buyer is not in court, how does the seller know in fact that the real estate agent has the authority to bid and also have the authority to bid to a certain price?

The judge delayed the sale by putting it on second call. That means that the entire calendar is called in court and then they return to various matters.

One of the agents was able to obtain the necessary documentation allowing him to bid on behalf of his buyer. The other agent left and we received a call from a frustrated and upset buyer who did not understand why if his agent had a check for the over bid amount why he could not have his agent represent him. We explained that short of some kind of authority, another person cannot bid on behalf of a person who is absent from the hearing.

So, a lesson was learned today. We have revised our instructions for coming to over bid in a probate court hearing to include the fact that both the buyer and the agent need to be present.

Professional Investors Move Into Flipping Foreclosed Properties

An August article in the LA Times noted a surge in “flipping foreclosed homes” by wealthy individuals and equity funds. Flipping is a buy- low, fix- up, sell-high strategy that has worked for entrepreneurial types, who often move from house to house along the way. Today’s “flippers” are taking advantage of deeply discounted prices at public auctions to buy extremely low, make wholesale improvements and turn a quick profit. The article definitely caught our attention since we are seeing the very same thing with our Probate and Trust listings. This is especially so with our probate sales in South Los Angeles County. For example, a property we sold recently on 29th Street, near USC generated huge interest from investors. We had at least five over- bidders in court and the property went for nearly twice what we listed it for! The investment group that purchased it will turn it into student housing.

Home Prices Increase $5,000 in July, Sales Fall

Orange County’s median home price inched up $5,000 in July from a month ago, but sales levels fell by nearly 26%, loosing the boost of federal home buyer tax credits.
The median price for an OC home was $450,000 in July, about a 1% gain from a month ago, according to San Diego-based MDA DataQuick, a unit of Canada’s MacDonald Dettwiler and Associates.
The median price here now is $30,000 or 7.1% higher than a year earlier, but still is about 30% below OC’s highest median price, set in the summer of 2007.
Sales in OC totaled 2,527 in July. That’s a 26% decline from a month ago and a 19% drop from a year ago.
June’s sales volumes were boosted by buyers facing a June 30 deadline to take advantage of an $8,000 federal tax credit, which has since been extended to this fall.
For all of Southern California, the median price for a home was $295,000 in July, down $5,000 from June’s prices but up 10% from a year ago.
Southland sales totaled 18,946 in July. That’s down nearly 21% from June’s totals, and also about a 21% decrease from a year ago.
It was the steepest year-over-year decline for Southland sales since March 2008, according to MDA DataQuick’s figures.
Foreclosure resales accounted for a 34% of the Southland’s resale market last month. That’s down from a high rate of 56.7%, set in early 2009, according to MDA DataQuick’s figures.

Aug. 15: Last day to apply for state first-time buyer tax credit


The Franchise Tax Board (FTB) recently announced it will accept applications for the California first-time home buyer tax credit through midnight on Sunday, Aug. 15, 2010. The FTB believes it will have received more than enough applications to cover the $100 million allocated for eligible first-time home buyers. It will continue to accept applications for the new-home portion of the state tax credit.
Due to the high volume of faxes the FTB is receiving, consumers may experience some delays and difficulties in connecting to the fax number during normal business hours. It can take several minutes or possibly up to an hour to connect and transmit the fax. Buyers who receive a busy signal are advised to try again later. The fax number is open 24 hours a day, so consumers may fax applications during non-business hours when the line is not as busy.

June Home Sales Report

Following is a excerpt from an LA Times article that reports home sales numbers for June of this year compared to last year.



Per the LA Times........

Existing, single-family home sales decreased 4.2 percent in June compared with June 2009.
The statewide median price of an existing single-family home increased 13.6 percent in June to $311,950 compared with June 2009.

“Buyers who scrambled to close escrow in May to take advantage of federal and state tax credits before they expired impacted the number of homes sold last month,” said C.A.R. President Steve Goddard. “Although we expect sales to be lower in the second half of the year because of the absence of the government stimulus, they should remain above the long-run average and be significantly higher than the trough in 2007, when sales bottomed out.


“Although the tax credits are no longer available, it’s important to keep in mind that home prices are substantially below their peaks and interest rates remain at historic lows, making this a very affordable time for many first-time buyers to purchase a home of their own,” he said.


Closed escrow sales of existing, single-family detached homes in California totaled 492,800 in June at a seasonally adjusted annualized rate, according to information collected by C.A.R. from more than 90 local REALTOR® associations statewide. Statewide home resale activity decreased 4.2 percent from the revised 514,230 sales pace recorded in June 2009. Sales in June 2010 decreased 11.1 percent compared with the previous month.

Death of a Real Property Owner

The Sanborn Team recently attended a very informative meeting with L.A. County Assessor, Rick Auerbach. During that meeting he discussed tax issues important for homeowners and what to do upon the death of a real property owner. In a nutshell……..


Death of a Real Property Owner

“The Assessor’s Office must be notified upon the death of an owner within 150 days of the date of death, or, if the estate is probated, prior to or at the time the inventory and appraisal is filed with the court clerk. The Change in Ownership Statement Death of Real Property Owner form is required to be completed and submitted to the Assessor’s Office, even if the decedent held the property in a trust. Failure to file a Change in Ownership Statement within the time prescribed by law may result in a penalty of either $100 or 10% of the taxes applicable to the new base year value of the real property or manufactured home, whichever is greater, but not to exceed $2,500 if that failure to file was not willful. This penalty is added to the assessment roll and is collected like any other delinquent property tax and subject to the same penalties for nonpayment.”

The Fiduciary's Dilemma through the Probate sale

Overbidders in Probate Court!

Yesterday was an exciting day in court with two of our three properties sold well over the starting bid. Even though these properties went to court twice and got postponed both times, we were still able to sell the properties for more than we ever thought. The Sanborn Team knows South Los Angeles


The Sanborn Team knows a thing or two about properties in South Los Angeles. For over 20 years, we have sold multiple properties in and around that area.

The following LA Times article caught our attention http://latimesblogs.latimes.com/lanow/2010/04/south-la-again-a-houseflipping-hot-spot.html It talks about foreclosures in the area and investors who are buying the properties and flipping them within six months. What the article didn’t discuss is that there are other properties for sale in South Los Angeles, that aren’t foreclosures that are also getting a lot of attention from investors and “house flippers.” Such properties are Probate Real Estate Listings.

In 2009, we started to notice that the investors were back in the market after being very quiet for a couple of years, especially in the South Los Angeles real estate market. Every probate real estate listing that we have put on the market in South Los Angeles, has been swarmed by investors, contractors and developers. Home Buyer Tax Credit update

We have great news to share with our fellow Californians purchasing their piece of the American dream. Federal and state governments are now offering tax credits for first-time homebuyers. Federal law offers up to $8,000 and $6,500 for long-time residents. California residents can now receive up to $10,000 for first time buyers OR buyers of properties that have never been occupied.
